FALL FROM CONSTRUCTION SITE SCAFFOLD RESULTS IN $1,020,000 SETTLEMENT PLUS FULL WORKERS COMPENSATION

The 22 year old construction worker was directing the lift of pre-assembled roof trusses to the top of a three story building in San Jose in 2014 when he leaned against a guardrail that was not properly secured causing him to fall and land on his head and face. The defendants claimed the worker fell while climbing up the outside of the scaffolding. There were no witnesses to the fall and the worker had no memory of what happened. We proved that a guardrail was not properly secured to the vertical uprights of the scaffold by the scaffold company. We also proved that the general contractor was liable for failure to inspect the scaffold each day. The case settled for payment of $800,000 cash and resolution of a $220,000 worker compensation lien. We also obtained full workers compensation benefits for the worker including lifetime medical coverage.
