Prosecuting Public Entities

Government entities can be held responsible for injuries caused by negligence of government workers and dangerous conditions. The lawyers at Van Blois Law have successfully prosecuted cases against public entities for over 40 years.

Governments are protected by immunities that allow them to avoid liability in many cases. For example, negligent police operations are almost completely immunized. In order to bring a successful case against a City, County or State agency or employee, a highly skilled and experienced lawyer is necessary. The California Government Code controls these cases but there are ways to avoid losing public entity case. There are mandatory duties that cannot be violated and there is case law that defines most areas of liability.

R. Lewis Van Blois, the attorney who filed the suit on behalf of the Cukors, said Thursday that the Police department had "plenty of officers" on duty that night but the department's priority was to have them monitor Occupy Wall Street protesters who were marching from Oakland to Berkeley.
