$3,375 million settlement for construction worker paralyzed in fall when framing contractor failed to install second story guardrail.

A Stockton drywall taper working on the construction of a townhouse in Dublin California fell from the second story because the framing contractor failed to install a guardrail. The fall resulted in partial paraplegia. The general contractor and framing subcontractor argued that it was visibly obvious that a guardrail was not present and the plaintiff was negligent when he stepped off the second floor. We responded that it was foreseeable that a drywall worker would focus on his task when looking up while working on the ceiling and a guardrail was required for safety purposes. The superintendent for the general contractor admitted in his deposition that he was responsible to ensure a safe project.
